An enterprise agreement is an agreement between one or more employers that sets out the minimum terms and conditions of employment for employees. It can override an applicable modern award subject to compliance with the Fair Work Act 2009 (Cth) and, in particular, the Better Off Overall Test (BOOT Test). A bargaining process must be undertaken with a vote of employees and final approval by the Fair Work Commission.
